Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the websites, products, and services ("Services") provided by FlowStateCommerce ("we," "us"). By purchasing a package, submitting a form, or otherwise using our Services, you agree to be bound by these Terms and our Terms of Sale.

2. Our services

FlowStateCommerce designs, builds, and (where included) hosts websites for small businesses. The specific deliverables, number of pages, revisions, and timeline depend on the package you purchase, as described on our Packages & Pricing page.

3. Your responsibilities

• Provide accurate business information, content, and assets via our onboarding questionnaire in a timely manner.
• Ensure you own or have the right to use any content, logos, images, or trademarks you provide to us.
• Respond to review requests so we can meet the estimated timeline. Delays in your response may extend the delivery date.

4. Payment

Prices are listed on our Packages page. Payment is due in full at checkout. All payments are non-refundable and all sales are final, as set out in our Terms of Sale. Payments are processed securely by Stripe; by paying you also agree to Stripe's terms. The required Care Plan ($99.99/month) bills monthly after launch and keeps your site hosted, maintained, and running.

5. Revisions & scope

Each package includes a set number of revision rounds. Work beyond the agreed scope (additional pages, features, or revision rounds) may be quoted as an add-on or change order before we proceed.

6. Ownership

Upon full payment, you own the final website files, your content, and your domain. FlowStateCommerce retains the right to display non-confidential work in our portfolio unless you request otherwise in writing.

7. Hosting & third-party services

Included hosting is provided for the first year. We are not responsible for outages or issues caused by third-party providers (e.g., domain registrars, payment processors, hosting infrastructure), though we will assist in good faith.

8. Cancellations & refunds

Cancellations and refunds are governed by our Terms of Sale and Refund Policy, which are incorporated into these Terms by reference. All payments are non-refundable and all sales are final.

9. Limitation of liability

To the maximum extent permitted by law, FlowStateCommerce's total liability for any claim arising out of the Services is limited to the amount you paid us for the applicable package. We are not liable for indirect, incidental, or consequential damages, including lost profits.

10. Changes to these terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Services constitutes acceptance of the revised Terms.
