What you agree to when you check the box at checkout and pay.
By checking the box at checkout and/or submitting payment, you ("Client") agree to these Terms of Sale with FlowStateCommerce ("we," "us"). Please read them before you pay.
We design, build, and deliver websites and related services as described in your order, proposal, or project agreement (the "Services"). Anything outside that described scope is not included and may require additional time and fees.
Fees are due in full as stated at checkout or in your project agreement. The required $99.99/month Care Plan bills monthly after launch and keeps your site hosted, maintained, and running. We are not obligated to begin or continue work until due payments are received.
All payments are non-refundable, and all sales are final. Once a payment is processed, you are not entitled to a refund, credit, or reversal for any reason, including change of mind, delay or failure to provide content or feedback, dissatisfaction, or a decision to cancel. We reserve time, tools, and capacity for your project in reliance on your payment.
You agree to provide the content, materials, access, and feedback we need in a timely way. Delays caused by you do not entitle you to a refund and may extend the timeline.
Your order includes the number of revision rounds stated in your package (Bronze 2, Gold 4) within the described scope. Additional revisions or changes to scope are billed separately at our then-current rates.
Domains, hosting beyond year one, premium themes, plugins, stock media, and similar third-party costs are your responsibility and are separate from and non-refundable independent of our fees, unless we state otherwise in writing.
Ownership of the final delivered website (excluding third-party and licensed components) transfers to you only after all payments are received in full. Until then, all work product remains our property.
We perform our work professionally, but we do not guarantee any specific business outcome, traffic, ranking, or revenue result.
Because all sales are final, you agree not to initiate a chargeback or payment dispute. An improper chargeback is a breach of these Terms, and you agree to be responsible for the original amount plus any related fees and reasonable collection costs.
To the maximum extent permitted by law, our total liability under these Terms will not exceed the amount you paid us, and we are not liable for indirect, incidental, or consequential damages.
These Terms are governed by the laws of the State of Washington, and any dispute will be handled in the state or federal courts located in Washington.
